CUMULATIVE TRAUMA CLAIMS

The FELA’s statute of limitations is three years. In other words, the injured party has three years from the date of injury with which to file suit. Determining when this period begins to run in a cumulative trauma case can be difficult since the injury does not occur at any particular moment. It develops over time. Therefore prompt action on a potential claim is needed to determine when the statute of limitations may have begun in that particular case.
In general, the client must file suit to enforce his or her claims not more than three years after he or she knew or should have known of the injury and that the injury was likely related to railroad work. Predictably, the railroads often have a different view of when this period begins to run.
